Student Waiver Form and General Media Release
The student or instructor named on this application acknowledges that the system and name of Zhong Xin Dao / I Liq Chuan, together with the Zhong Xin Dao / I Liq Chuan Banner and logo and all materials both written and recorded and any derivative thereof are the intellectual property (The Work) of the Chin Family I Liq Chuan (CFILC).
CFILC agrees that the student or instructor named on the application has a limited right to use the intellectual property described above subject to terms and conditions of the CFILC which may be revoked at the discretion of the CFILC. If this permission is revoked the student or instructor must immediately cease and desist all use of said materials.
The student or instructor named on this application agrees that CFILC retains all rights in any techniques and/or teaching methods and curriculum of the CFILC.
The student or instructor assumes full risk and responsibility for any and all damages, injuries or losses to his/her person or property, which he/she may sustain or incur in connection with conducting or participating in Zhong Xin Dao / I Liq Chuan classes or workshops. He/she agrees that any member of the CFILC or promoters, operators and sponsors of the establishment, and their officers, agents or employees, shall not be responsible for any damages, injuries or losses to his/her person or property, which he/she may sustain or incur for any reason, cause or condition, whatsoever, including negligence. The student or instructor hereby releases and discharges each and all of them individually or otherwise of and from all claims, demands, rights or cause of action whatsoever, which he/she or his/her heirs, executors, administrators or assigns have or may have against them or any of them by reason of matter or incident, whether arising from their negligence or otherwise, in connection with his/her conducting or participation at any Zhong Xin Dao / I Liq Chuan class or workshop.
I read and understand and hereby consent to the participation of the minor, attending the Zhong Xin Dao / I Liq Chuan class or any of its aforementioned function, under the terms and conditions of this application, including the terms of release and covenant not to sue contained therein. If under 18 years of age, this release and consent must also be signed by a parent or a legal guardian.
By signing this release form, I hereby authorize Chin Family I Liq Chuan LLC (CFILC), to use the following personal information:
(1) My picture – including photographic, motion picture, and electronic (video) images.
(2) My voice – including sound and video recordings.
(3) My testimonial – including quotations.
I hereby irrevocably grant to CFILC, its legal representatives or assigns and those acting under its permission and upon its authority, or those for whom CFILC is acting, the absolute right and permission to record my likeness and/or voice on film, video, photography, or digital recording device, testimonial (written words), tape or videotape, to edit or change or alter such recording(s) at its sole discretion and to copyright and/or use such recording(s) in which I may be included in whole or in part or composite or distorted. All media copyright of such recordings goes to CFILC. This agreement applies to all future Zhong Xin Dao/I Liq Chuan events that I attend.
I hereby grant to CFILC, its subsidiaries, licensees, successors and assigns, the right to use, publish, and reproduce, in color or otherwise for art, advertising, trade or any other lawful purpose whatsoever in any media throughout the world, in perpetuity for all purposes, my name, pictures of me in film or electronic (video) form, sound and video recordings of my voice, and printed and electronic copy of the information described in sections (1), (2), and (3) above in any and all media including, without limitation radio, broadcast television. This permission extends to all languages, media, formats and markets now known or hereafter devised.
I further grant CFILC all right, title, and interest that I may have in the interview and all finished pictures, negatives, reproductions, and copies of the original print, without limitation the literary rights and copyright and further grant CFILC the right to give, sell, transfer, and exhibit the print in copies or facsimiles thereof, for marketing, communications, or advertising purposes, as it deems fit.
I hereby release filmmaker/photographer, his/her assistants, legal representatives and assigns, and CFILC from all claims and liability relating to said interview and filming.
I hereby waive the right to receive any payment for signing this release and waive the right to receive any payment for CFILC’s use of any of the material described above for any of the purposes authorized by this release.
I hereby waive any right that I may have to inspect or approve finished photographs, audio, video, multimedia, or advertising recordings and copy or printed matter or computer generated scanned image and other electronic media that may be used in conjunction therewith or to approve the eventual use that it might be applied.
